This includes obtaining a fixed wiring Electrical Installation Condition Report (EICR) at least every five years, unless a qualified electrician advises more frequent inspections are needed.

Gas Safety for Landlords

If you’re a landlord with gas appliances in a rental property, you have a legal responsibility to ensure they are safe to use. The Gas Safety (Installation and Use) Regulations 1998 require landlords to arrange regular safety checks and keep their gas appliances, pipework and flues properly maintained.

 

An annual gas safety check must be carried out by a qualified engineer who is registered with the Gas Safe Register. Once the inspection is complete, you’ll receive a landlord gas safety certificate, also known as a CP12 or gas safety record. This confirms that the relevant gas appliances and installations have been checked for safety.

 

What are a landlord’s gas safety responsibilities?

Landlords must ensure that:

  • All gas appliances, pipework and flues are maintained in a safe condition.
  • Gas appliances are serviced in accordance with the manufacturer’s instructions.
  • A gas safety check is carried out every 12 months by a registered Gas Safe engineer.
  • Tenants receive a copy of the landlord gas safety certificate within 28 days of the check, or before they move into the property if they are new tenants.
  • Gas safety records are kept for at least two years.

 

Landlords should also make sure tenants know how to safely turn off the gas supply and understand what to do in the event of a gas emergency.

Smoke Alarms

As of 1st February 2022, all homes in Scotland must meet the Tolerable Standard for fire detection systems. This applies to both homeowners and landlords.

 

Properties must have:

  • Smoke alarms in every circulation space (e.g. hallways and landings)
  • A smoke alarm in the main living area
  • A heat alarm installed in every kitchen
  • All alarms interlinked for maximum protection
  • Carbon monoxide alarms where required

 

These measures significantly improve early detection and can save lives in the event of a fire.

Carbon Monoxide Alarms

Carbon monoxide is a silent danger. You cannot see, smell, or taste it. Exposure can be fatal within minutes.

  • Headaches
  • Dizziness
  • Nausea
  • Breathlessness
  • Collapse
  • Loss of consciousness

Legionnaires Disease

Legionnaires’ disease is a serious and potentially fatal form of pneumonia caused by inhaling water droplets contaminated with Legionella bacteria. These bacteria can develop in man-made water systems, particularly where water is stored or circulated at certain temperatures.

 

Landlords have a legal duty to:

  • Identify and assess potential risks within water systems
  • Implement control measures to minimise those risks
  • Maintain records of risk assessments and actions taken

 

A Legionella risk assessment should be carried out and reviewed at least annually, or whenever there are changes to the water system or tenancy.
